Questions

What is included in a final settlement in the UAE?

Usually any salary not yet paid, the value of unused annual leave, end-of-service gratuity, and pay for any notice period that was paid instead of worked — less amounts the employee owes the employer.

When must the final settlement be paid?

Within 14 days of the end of the contract, along with all other outstanding entitlements (Article 53 of Federal Decree-Law No. 33 of 2021).

Is unused leave paid on basic or total salary?

On basic salary. When service ends, the Executive Regulations pay the leave balance according to the basic wage (Cabinet Resolution No. 1 of 2022, Article 19). Check your contract for anything more generous.

Is notice pay worked out on basic or total salary?

On the full wage. Article 43 calls it the notice period allowance and sets it at the worker's wage for the notice period, or the part not worked, at the last wage received — and the law's definition of wage includes allowances.

Does resigning change the gratuity?

Not under the 2021 law: resignation and termination are treated the same way once at least one year of continuous service is complete.

What if the employee worked less than a year?

No gratuity is due under one year of continuous service (Article 51). Unpaid salary, unused leave and any notice pay are still owed.

What can the employer deduct from a final settlement?

Only amounts payable under the law or a court judgment (Article 51(7)). The Executive Regulations list them: loan repayments and amounts paid in excess, pension and insurance contributions, deductions under an approved penalty regulation, court-ordered debts, and repair of damage the worker caused.

Is this figure legally binding?

No. It is an estimate built on the standard statutory rules and the assumptions stated beside the result. Contract terms, deductions and the circumstances of leaving can all change it. For a binding figure, speak to your employer, your PRO or MOHRE.
